Roundtable with NM Court of Appeals Judges

On Tuesday, NMHCA's Legal & Liability Sub-Committee hosted a judicial roundtable with several judges from the New Mexico Court of Appeals. The event allowed for a casual discussion with Judges Hank Bohnhoff, Stephen French, Daniel Gallegos, and Emil Kiehne. Roundtable participants engaged in discussions regarding the judges' professional backgrounds and judicial philosophies as well as shared insights on the impact of the legal environment and increasing liability costs on the quality of long-term care in New Mexico. Adressing the LTC Workforce Crisis

In June, NMHCA Board of Director, Mark Schinnerer, convened a roundtable discussion of long-term care leaders in Washington, DC, at the American Health Care Association's Congressional Briefing to discuss common challenges, which included the workforce crisis. LTC Policy Points
Centers for Medicare and Medicaid Services Issues Final Rule.

Yesterday, the Centers for Medicare & Medicaid Services (CMS) issued a final rule [CMS- 1696-F] outlining proposed Fiscal Year (FY) 2019 Medicare payment rates and quality programs for skilled nursing facilities (SNFs). The FY19 final rule establishes a market basket increase of 2.4 percent, a figure statutorily mandated by Congress, and will start October 1, 2018.

Based on changes contained within this final rule, CMS indicates aggregate payments to SNFs will increase in FY19 by $820 million, or 2.4 percent, from payments in FY18 - $30 million less than in the Notice of Proposed Rulemaking. AHCA is exploring potential issues with FY19 rates and impact analysis. At the same time, CMS notes that the overall economic impact of the SNF Value-Based Purchasing Program (VBP) is an estimated reduction of $211 million in aggregate payment to SNFs during FY19.

New Mexico Statewide Immunization Registry

The New Mexico Department of Health will hold a public hearing on the adoption of a new rule, 7.5.5 NMAC, “New Mexico Statewide Immunization Registry” or NMSIIS, on September 13, 2018, in Santa Fe. The proposed rule will add sanctions to entities, including long-term care facilities, that may be non-compliant with reporting immunization information to the statewide registry.

NMSIIS reporting has been in effect for long-term care since 2013 and is mandatory for all immunization providers. If your facility has not already started immunization reporting, you must first contact the New Mexico Department of Health Help Desk at 1-800-280-1618 or 505-476-8526 and register, along with getting training for reporting any immunizations given by facility. NMHCA is excited to continue our partnership with HealthInsight to present Quality Awards to eligible nursing homes in New Mexico. The criteria for the HealthInsight Quality Awards are available and applications are being accepted. Please find the criteria for hospitals, nursing homes, home health agencies, and physician practices here

The HealthInsight Quality Awards will be presented at the NMHCA Leadership Symposium in February.
