Annual Membership Meeting

The NMHCA/NMCAL Board of Directors has called for a meeting of the membership on Wednesday, August 18, 2021, beginning at 7:30 am at the Embassy Suites - Albuquerque located at 1000 Woodward NE. The primary purpose of this meeting is to elect the 21-22 Board of Directors. All member facilities may have 1 representative attend at no cost, but please RSVP so we can have accurate counts for space and breakfast.  Download the RSVP form here.

CMS Proposes CY 2022 Medicare Physician Payment Rule

Late yesterday, CMS issued a proposed rule on payment policies for the calendar year (CY) 2022 under the Medicare Physician Fee Schedule (PFS) Quality Payment Program and Other Revisions to Part B. The public comment period will close on September 13, 2021.

For CY 2022, CMS is proposing a conversion factor of $33.58, a decrease of $1.31 from the CY 2021 PFS conversion factor of $34.89. This proposed conversion factor takes into account the proposed budget neutrality adjustment to account for changes in relative value units required by law, and the expiration of the temporary 3.75% payment increase provided for CY 2021 by the Consolidated Appropriations Act, 2021. 

AHCA is still analyzing the proposed rule, but upon initial review, it appears that: 
  • Net Part B therapy payments will be reduced by approximately 2%, a significantly lower cut than expected.  
  • Proposed coding policy changes are intended to resolve problems with reporting Part B physical and occupational therapy assistant services on claims. This will minimize the impact of implementing therapy assistant payment adjustments that start in CY 2022.
  • Improvements to proposed policies and rates for SNF resident-related services, including portable x-ray, clinical lab, and vaccine administration.  
  • CMS proposes to extend the retention of all services added to the Medicare telehealth services list (including several physician and therapy services) on a temporary Category 3 basis beyond the COVID-19 public health emergency end date for further evaluation until the end of CY 2023, and favorably modify other related policies regarding coverage of other communications technology. 
  • CMS is proposing several modifications to the Medicare Shared Savings Program that may impact SNF providers participating in Accountable Care Organizations.

OSHA ETS Comments Wanted - Deadline Extended


As you may be aware, effective June 21 the Occupational Safety and Health Administration (OSHA) released Emergency Temporary Standards (ETS) to address exposure to COVID-19 to workers in healthcare settings.  This healthcare ETS applies to skilled nursing facilities, assisted living communities, and Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICFs/IID).  Compliance is required within 14 days (July 6) for most items and 30 days (July 21) for a few requirements.  Please visit the AHCA/NCAL website for a link to webinar for further details along with links to OSHA resources.
 
AHCA/NCAL is asking members to submit comments before the August 20 deadline.  Comments may be submitted online here.  Attached please find a PDF of the PowerPoint presentation with details about the ETS.  Priority areas outlined in the PowerPoint to include in comments are:
 
  • Recognizing Good Faith Efforts
  • Reporting to Other Employers
  • Consistent Guidance
  • Supports through Consultation

Question Submission Schedule

Due to the DoH requirement of questions being submitted to them 72 hours in advance, please remember to submit your questions to covid19@nmhca.org according to the following pattern. 
  • Nursing Facilities: By noon on the Thursday before the Monday call. 
  • Assisted Living Facilities: By noon on the Friday before the Wednesday
  • Intermediate Care Facilities: By noon on the Tuesday before the Friday call by noon. 

Infection Control Training

As a reminder, all facilities must take the State infection control training. This is in addition to other infection control programs your staff may have taken. The letter of direction can be found here, and instructions on accessing the training can be found here
